This Terms & Conditions and Membership Agreement (the "Agreement") is entered into by and between [Viofun Yazılım Anonim Şirketi], [Tax Office: Antalya Kurumlar, Tax No: 9251268295], [Pınarbaşı Mah. Hürriyet Cad. Akdeniz Üniversitesi Antalya Teknokent Ar-Ge 2 Uluğbey Binası No:3A/B178, Konyaaltı / Antalya, Turkey] ("DocOnWay", the "Company", "we") on the one part, and the natural person using the DocOnWay website, mobile interfaces, communication channels, AI-assisted assistant, and related digital services ("User", "you") on the other part.
By visiting the DocOnWay platform, creating an account, creating a booking request, making a payment, or otherwise using the platform, you represent that you have read, understood, and accepted this Agreement. If you do not accept this Agreement, you must not use the platform.
In this Agreement: "Platform" means the website, applications, chat interfaces, CMS/booking infrastructures, and related digital services belonging to DocOnWay; "Healthcare Service Provider" or "Provider" means independent doctors, clinics, hospitals, laboratories, or other healthcare institutions accessible through DocOnWay; "Booking" or "Request" means examination requests, home/hotel visits, clinic/hospital appointments, online consultations, or similar service requests created through the platform; and "Content" means texts, images, documents, reviews, messages, and data.
DocOnWay is not a healthcare service provider. DocOnWay is a digital platform that facilitates users' access to independent healthcare service providers, and provides booking and coordination, as well as communication and routing infrastructure. Medical services offered through the platform are provided by independent providers under their own professional and legal responsibility.
DocOnWay does not provide medical diagnosis, prescribing, treatment, clinical decision-making, or emergency medical intervention services. Descriptions, guidance, AI-assisted responses, and content on the platform are for general information and coordination purposes only and do not replace professional medical advice.
In order to use the platform, you must have the legal capacity to enter into a binding agreement under applicable law. As a rule, you are expected to be at least 18 years old. If you act on behalf of a minor patient, you represent that you are the parent, legal guardian, or authorized representative, and that you are authorized to share information, create bookings, and establish communication for the relevant person.
You agree that all information you provide when creating an account or a booking request is accurate, current, complete, and not misleading. DocOnWay cannot be held responsible for service disruptions arising from incorrect, outdated, incomplete, or fraudulent information.
You are responsible for keeping your account information and login credentials confidential. You are responsible for transactions carried out using your login credentials unless you notify us of unauthorized access without unreasonable delay. In the event of suspicious access, security breaches, or misuse of the account, we reserve the right to limit access, request identity verification, or suspend the account.
Every request made through the platform does not constitute an immediately finalized commitment for the provision of a healthcare service. Your booking request may be approved, rerouted, alternative providers may be suggested, or the request may be rejected on reasonable grounds, depending on referral to a suitable provider, provider availability, geographic access, clinical suitability, timing, legal restrictions, and operational evaluation.
DocOnWay may attempt to determine the suitable provider category and type of service based on the information shared by the user; however, the final clinical suitability assessment belongs to the relevant provider. As a result of its own professional evaluation, the provider may change the form of examination, request additional information, recommend an in-person evaluation, or decline the request for medical reasons.
If you share symptoms, complaints, location, age, contact information, insurance information, hotel information, or similar data for booking or routing purposes, you consent to such data being processed for the purpose of handling your request, being transmitted to suitable providers, coordinating the service, and offering support to you, and being shared with relevant providers to the extent necessary. If you share data on behalf of another person, you represent that you are authorized to do so and that you have informed the relevant person.
DocOnWay is designed exclusively for non-emergency medical needs. In the event of chest pain, severe respiratory distress, loss of consciousness, signs of stroke, major trauma, severe allergic reaction, active heavy bleeding, or similar emergencies, you should contact local emergency services immediately instead of using the platform. The emergency number in Turkiye is 112.
Prices, fees, or price ranges shown on the platform may, unless explicitly stated otherwise, be for informational purposes and may vary depending on the provider, location, time, service type, clinical scope, additional tests, translation needs, or similar factors. The final fee may be communicated at the payment stage or following provider confirmation, where appropriate.
Where DocOnWay collects a payment through the platform, that amount is collected as a platform-handled charge for the requested care route and related coordination scope. Additional medical fees may apply depending on the provider's final clinical assessment, extra tests, treatment, medication, transport, or service conditions, and such fees may be billed directly by the provider where applicable.
In some services, payment may be made directly to the provider, while in some services it may be made to DocOnWay or to a third-party payment service provider. When making a payment, you represent that you are the lawful holder of the payment instrument used or that you are otherwise authorized to use it. DocOnWay is not responsible, except to the extent of its own fault, for delays and errors arising from banks, card institutions, payment infrastructure providers, or providers.
Taxation, invoicing, and legal financial record obligations may be fulfilled by the provider, DocOnWay, or the relevant payment service provider, depending on the nature of the transaction. If you are presented during the transaction with an Information Notice, Payment Terms, Cancellation/Refund Policy, or Distance Service Agreement, those texts shall be deemed an integral part of this Agreement and shall prevail for the relevant paid transaction.
The conditions regarding cancellation, rescheduling, no-show, late arrival, or refund of a Booking may vary depending on the service type, provider rules, reservation timing, operational preparation, and applicable mandatory law. If the doctor has already departed, provider capacity has been reserved, or additional operational costs such as night/special time planning, interpreter, or transport have arisen, a partial or full charge may apply.
In cases of provider-side cancellation, unreasonable delay, or operational error attributable to DocOnWay, options such as rescheduling, issuing credits, or refunds may be offered in accordance with applicable law and transaction-based policies. If the user provides an incorrect address, is unreachable, provides incorrect contact details, or is not ready at the appointment time, a refund may not be available and/or transaction-based deductions may apply.
Sharing insurance information or assistance company information does not mean that the service will necessarily be covered by insurance. Coverage, scope, authorization, direct billing, and reimbursement decisions are subject to the relevant insurance company, assistance organization, and provider policy. DocOnWay does not guarantee insurance coverage; it may only provide coordination support.
You agree to use the platform in accordance with the law, the principle of good faith, and this Agreement. In particular, it is prohibited to create false accounts, act on behalf of another person without authorization, provide misleading health information, behave in a threatening or abusive manner toward providers, or use the platform for spam, scraping, robots, reverse engineering, security testing, unauthorized data extraction, competitive intelligence, or unlawful purposes.
DocOnWay may, to the extent it deems reasonable, take technical and administrative measures to protect the platform and provider network; investigate suspicious transactions; suspend accounts, requests, or payments; and request additional verification.
If you share reviews, ratings, feedback, or messages through the platform, you agree that such content is lawful, truthful, non-defamatory, and does not infringe third-party rights. DocOnWay may remove, anonymize, decline to publish, or moderate misleading, unlawful, defamatory content, content violating personal rights, or content disclosing excessive personal health data.
The design of the platform, trademarks, software, databases, user interfaces, texts, graphic elements, and all other intellectual property elements belong to DocOnWay or its licensors. This Agreement grants you only a limited, revocable, non-transferable right to use the platform for personal and legitimate purposes and does not create any transfer of ownership.
Providers, payment service providers, communication tools, map/infrastructure services, and similar third-party services may be independent from DocOnWay. Although DocOnWay may apply reasonable onboarding, documentation, and operational controls, it does not guarantee the continuous availability of providers, their every clinical decision, every medical outcome, or the error-free operation of third-party systems.
The platform may from time to time become inaccessible due to maintenance, updates, capacity constraints, cybersecurity, connectivity, supplier systems, force majeure, or actions by public authorities. To the extent permitted by applicable law, DocOnWay provides the platform "as is" and "as available." Without prejudice to your mandatory legal rights, no warranty is given that access will be uninterrupted, that the platform will operate without error, or that a particular result will be achieved.
The collection, use, sharing, storage, and international transfer of personal data and health data are subject, in addition to this Agreement, to the DocOnWay Privacy Policy, Cookies Policy, and, where necessary, to specific information notices/explicit consent texts. By using the platform, you also represent that you have read and accepted those texts to the extent applicable under relevant law.
DocOnWay may use AI-based or rules-engine-supported tools to support user experience and initial routing. These tools do not diagnose, prescribe, provide emergency services, or replace the provider's clinical assessment. The user acknowledges that responses generated by such tools are limited to information and coordination purposes.
Without prejudice to mandatory consumer law, personality rights, and rules concerning intent/gross negligence, DocOnWay shall not be responsible for damages arising from the provider's diagnosis, treatment, prescription, medical intervention, medical negligence, complications, clinical outcomes, or the user's relationships with providers outside the platform. DocOnWay's liability shall be evaluated only to the extent of its own gross negligence or clear contractual breach and within the maximum limits permitted by law.
Subject to mandatory legal provisions, liability is excluded for indirect damages, loss of reputation, travel plan changes, loss of profit/revenue, or similar consequential losses. If mandatory law permits with respect to a paid platform service, DocOnWay's total liability may be limited to the amount of service fees actually paid by the user to DocOnWay within a reasonable period preceding the relevant claim.
You agree, to the extent permitted by applicable law, to indemnify DocOnWay for reasonable damages, costs, administrative sanctions, professional fees, and third-party claims arising from your breach of this Agreement, unlawful use, infringement of third-party rights, provision of false information, or misuse of the platform.
DocOnWay may temporarily or permanently suspend or terminate your account, bookings, or access due to breach of this Agreement, suspicion of fraud, misuse, security risk, legal obligation, provider safety, payment risk, or the need to protect platform integrity. You may also stop using the platform by closing your account. Closure of the account does not eliminate payment, dispute, data retention, and legal obligations that arose prior to the date of closure.
DocOnWay may update this Agreement from time to time. Material changes may be communicated by reasonable means. Your continued use of the platform after publication of the updated text shall mean, without prejudice to separate acceptance mechanisms required by mandatory law, that you have accepted the current version.
This Agreement shall be governed by the laws of the Republic of Turkiye, excluding conflict of law rules. Mandatory rights of users who qualify as consumers to apply, complain, or file actions remain reserved. Mandatory provisions regarding competent consumer arbitration committees, consumer courts, or other mandatory authorities at the user's place of residence shall apply with priority where relevant.
If any provision of this Agreement is found invalid, the validity of the remaining provisions shall not be affected. Failure to exercise any right shall not be deemed a waiver of that right.
This Agreement may be published in more than one language. Unless expressly stated otherwise, and without prejudice to mandatory local consumer law, the [Turkish / English] version shall prevail for interpretation.
