Distance Service Agreement

Effective Date: May 6, 2026

This Distance Service Agreement governs the digital coordination and booking support services provided through DocOnWay. It is designed for non-emergency healthcare coordination in Turkey and should be read together with the Terms & Conditions, Privacy Policy, Payment & Service Terms, and Cancellation & Refund Policy.

1. Parties

This agreement is concluded between DocOnWay, operated by Viofun Yazılım Anonim Şirketi, Tax Office: Antalya Kurumlar, Tax No: 9251268295, with registered address at Pınarbaşı Mah. Hürriyet Cad. Akdeniz Üniversitesi Antalya Teknokent, Ar-Ge 2 Uluğbey Binası No:3A/B178, Konyaaltı / Antalya, Turkey, and the user who creates a care request, payment request, or related service request through the platform.

2. Definitions

In this agreement, "platform" means the DocOnWay website, AI-assisted intake flow, communication interfaces, and related digital systems; "user" means the traveler, patient, or authorized representative using the platform; "provider" means the independent doctor, clinic, hospital, dentist, laboratory, or similar healthcare institution that may receive the request; and "service" means the digital coordination, routing, and booking-related support offered by DocOnWay.

3. Subject of the Agreement

The subject of this agreement is the remote provision of a digital coordination and booking support service that helps users submit a care request, share relevant information, identify a suitable care route, communicate with independent providers, and where applicable complete payment collection through the platform.

4. Nature of DocOnWay's Role

DocOnWay is not a healthcare provider, hospital, clinic, ambulance operator, or emergency service. DocOnWay does not diagnose, prescribe, treat, perform examinations, or make clinical decisions. Its role is limited to digital intake, care coordination support, operational routing, and payment-related platform functions.

5. Service Description

The platform may help collect complaint details, preferred service type, location, language, timing, and contact information; recommend a suitable care route; transmit request details to independent providers; facilitate scheduling and operational follow-up; and where available collect payment for the platform-supported request flow.

6. Price, Payment and Third-Party Payment Providers

Any price, estimate, or amount shown on the platform relates to the relevant care request and platform-supported coordination flow as described at the time of checkout. Payment may be collected by DocOnWay or processed through authorized third-party payment service providers. The user accepts that banking, card, and payment infrastructure services may be supplied by third parties.

7. Provider-Billed Additional Medical Fees

Additional medical fees may apply depending on the provider's final clinical assessment, tests, treatment scope, medication, transport, extended time requirements, or local service conditions. Where applicable, such additional medical fees are billed by the independent provider, not guaranteed or fixed by DocOnWay.

8. Formation of the Contract

This agreement becomes effective when the user confirms the relevant steps on the platform, accepts the applicable legal texts, and where required completes payment submission through the secure payment flow. Submission of a request does not by itself guarantee provider acceptance, provider availability, or final booking confirmation.

9. Booking Confirmation

A booking becomes confirmed only after the relevant payment process, where applicable, is verified and DocOnWay or the independent provider completes the operational confirmation step. DocOnWay may need to reroute the request, propose an alternative care route, or decline a request on reasonable operational or provider-side grounds.

10. Right of Withdrawal and Early Performance

Users may have rights under Turkish consumer law in relation to distance contracts. However, because the requested digital coordination service may begin immediately upon the user's express request, the user acknowledges that the right of withdrawal may be limited or waived once performance starts, to the extent permitted by applicable law.

11. Cancellation, No-Show and Refund Reference

Cancellation, no-show, late-arrival, and refund handling may vary by provider availability, timing, route dispatch, operational preparation, and mandatory law. The user should also review the Cancellation & Refund Policy and Payment & Service Terms referenced elsewhere on the platform.

12. Independent Healthcare Providers

All healthcare services, examinations, medical advice, treatment, and prescriptions are provided solely by independent healthcare providers under their own professional and legal responsibility. DocOnWay is not responsible for clinical decisions or medical outcomes except to the extent of its own fault under applicable law.

13. Non-Emergency Use

DocOnWay is for non-emergency coordination only. In a medical emergency in Turkey, users must call 112 immediately and must not rely on the platform, chat tools, or remote coordination features as a substitute for emergency services.

14. Dispute Resolution

This agreement is governed by the laws of the Republic of Turkiye. To the extent permitted by mandatory law, disputes may be brought before the competent consumer authorities, courts, or enforcement offices in Antalya. Mandatory consumer rights remain reserved.
